The
Purpose of the Agreement

The
purpose of the following terms and conditions is to set out the rights
and obligations of www.Email-by-Post.com (Email by Post Ltd) as a
provider of services to its customers, and the rights of its customers
whether they be registered or non-registered users of the Email-by-Post
service. The services provided by Email-by-Post, and the obligations in
relation to its customers in the provision of the services provided,
can be seen to be constant and independent of the mechanism by which
the customers contact Email-by-Post, which can include electronic
service requests via the world wide web, verbal, or written requests.

Email-by-Post
reserves the right to change the terms, conditions, and notices under
which the Email-by-Post Sites/Services are offered, including but not
limited to the charges associated with the use of the Email-by-Post
Sites/Services. You are responsible for regularly reviewing these terms
and conditions and additional terms posted on particular websites. Your
continued use of the Email-by-Post Sites/Services constitutes your
agreement to all such terms, conditions, and notices. |

Unless
otherwise specified, you may not modify, copy, distribute, transmit,
display, perform, reproduce, publish, license, create derivative works
from, transfer, or sell any information, software, products or services

Email-by-Post Sites/Services for any purpose that is unlawful or
prohibited by the defined terms and conditions. You may not use the

overburden, or impair any Email-by-Post Site/Service(s) (or the
network(s) connected to any Email-by-Post Site/Service(s)) or interfere
with any other party's use and enjoyment of any Email-by-Post
Site/Service(s). You may not attempt to gain unauthorized access to any
Email-by-Post Site/Service, other accounts, computer systems or
networks connected to any Email-by-Post Site/Service, through hacking,
password mining or any other means. You may not obtain or attempt to
obtain any materials or information through any means not intentionally
made available through the Email-by-Post Sites/Services. |

You specifically agree
that Email-by-Post is not responsible for
any unauthorised access to, alteration of, or the ultimate delivery
of, any communications requests associated with the services
provided by Email-by-Post,
or requested
from the Email-by-Post
website, or any other requested methods. Additionally
you agree that Email-by-Post is not responsible for any material or data
sent or received or not sent or received, or any transactions or
contracts of agreement entered into through an Email-by-Post website, or
using an Email-by-Post communications service.

You specifically agree
that Email-by-Post is not responsible or
liable for any obscene, defamatory, libelous, offensive, threatening, illegal or
offensive content, including statements that may infringe the rights of
any individual or company entitiy, sent or communicated using an Email-by-Post service by
any third party. |

In no event shall
Email-by-Post be liable for any damages whatsoever, connected
with the loss of data, information, or profits arising out of the
use of Email-by-Post services

Email-by-Post reserves the right to
terminate your access to any or all Email-by-Post Sites/Services at any
time, without notice. Email-by-Post may also terminate or suspend your access to Email-by-Post Site/Service(s) without
obligation to forward any unread or unsent communications to you or any
third party, without notice.

race, religion, or political affiliations, without your explicit

Email-by-Post
does not sell, rent or lease its customer lists to third parties, but
may, from time to time, contact you on behalf of external business
partners about a particular offering that may be of interest to you. In
those cases, your personal information (e-mail, name, address,
telephone number) is not transferred to the third party. |

web browsers, to a minimum. Email-by-Post cannot control the use
of "cookies" by Third Party Advertisement Networks that may be
advertising on any Email-by-Post websites. Email-by-Post reserves
the right to use "cookies" on its websites in a manner that is judged
by Email-by-Post to be appropriate.

Operation
of Email-by-Post |

4.1 |
As
an automated service of collection of communications requests,
Email-by-Post aims to provide availability of this service to its
customers 24 hours a day 365 days a
year. Email-by-Post reserves the right to temporarily withdraw any or
all of its services for any period of time, without prior notification.
As a communication service provider Email-by-Post is dependent upon
other entities providing services and cannot be held responible for
failures of third party service providers.

Governing
Law |
|

5.1 |
The
terms and conditions outlined are governed by English Law, and the
jurisdiction of
the English courts. |

6. |
Refunds Policy |
|
|
6.1 |
In the event that Email-by-Post determines that the payment
of a refund is an appropriate course of action in the settlement of a disputed transaction, and where no alternative
settlement using goods and services can provide an agreed and acceptable alternative, the payment will be made in
the manner most appropriate to the customer, either directly via the WorldPay system in the customer's currency of payment, or
directly from Email-by-Post to the customer. |
